Stat Dec – Statutory Declaration for leave 

Stat Dec is a Statutory Declaration, a formal legal statement used in Australia to confirm that the information is true. It is commonly accepted by employers as evidence for workplace leave when a medical certificate is unavailable. 

A Stat Dec is regulated under the Statutory Declarations Act 1959 (Cth) and the relevant state and territory laws. Making a false declaration is a criminal offence. Employers may accept a Stat Dec for personal leave, carer’s leave, or other absences.  

Ways to create a Stat Dec for leave 

  • Complete an approved Stat Dec form (Commonwealth or state). 
  • Accurately explain why you were absent. 
  • Sign the declaration in the presence of an authorised witness. 
  • If available, use a Digital ID and an approved online platform. 

Employer requirements 

  • Evidence must meet the requirements of the Fair Work Act 2009. 
  • Employers decide whether to accept it, unless an award or agreement applies. 
  • It can be used when a medical certificate is not reasonably obtainable. 

Authorized witnesses (if not using Digital ID) 

  • Justice of the Peace (JP) 
  • Police officer 
  • Pharmacist 
  • Lawyer 
  • Medical practitioner 

Australians should understand Stat Decs as they provide a lawful and accessible means of evidence for leave, particularly in regional areas or when access to healthcare is limited.
