Stat Dec – Statutory Declaration for leave
Stat Dec is a Statutory Declaration, a formal legal statement used in Australia to confirm that the information is true. It is commonly accepted by employers as evidence for workplace leave when a medical certificate is unavailable.
A Stat Dec is regulated under the Statutory Declarations Act 1959 (Cth) and the relevant state and territory laws. Making a false declaration is a criminal offence. Employers may accept a Stat Dec for personal leave, carer’s leave, or other absences.
Ways to create a Stat Dec for leave
- Complete an approved Stat Dec form (Commonwealth or state).
- Accurately explain why you were absent.
- Sign the declaration in the presence of an authorised witness.
- If available, use a Digital ID and an approved online platform.
Employer requirements
- Evidence must meet the requirements of the Fair Work Act 2009.
- Employers decide whether to accept it, unless an award or agreement applies.
- It can be used when a medical certificate is not reasonably obtainable.
