Personal leave

Personal leave is a workplace entitlement that allows employees to take time off work if they are sick, injured, or required to care for an immediate family member.  

Personal leave is also known as sick or carer’s leave under the Fair Work Act 2009. It applies to most employees covered by the National Employment Standards (NES). 

Key aspects of personal leave 

  • Full-time employees receive 10 days of paid personal leave per year. 
  • Part-time employees receive a proportional amount based on their hours. 
  • Casual employees do not receive paid personal leave. 
  • Unused personal leaves accumulate and are carried forward each year. 

Valid reasons for use 

  • Personal illness or injury 
  • Caring for an immediate family member who is unwell or injured 
  • Managing an emergency involving a dependent 

Notice and evidence 

  • Employees must inform their employer as soon as possible. 
  • Employers may request evidence, such as a medical certificate or a statutory declaration.
